Terms of Service

These Terms of Service ("Terms") govern your access to and use of Swelis Hosting services, including our website, control panel, and hosted infrastructure (collectively, the "Services"). By creating an account, purchasing, or using the Services, you agree to these Terms.
1. Eligibility & Account
- You must be at least 13 years old (or the age of digital consent in your jurisdiction).
- You are responsible for maintaining the confidentiality of your credentials and securing your service‑level access (e.g., FTP).
- You agree that your account information is accurate, complete, and kept up to date.
2. Services
- We provide Minecraft server hosting and related tooling (e.g., provisioning, file access, metrics, backups where available).
- Service performance depends on your configuration (RAM/CPU/storage), software choices (plugins/mods), and workload.
- We may update platform components to maintain security, stability, and performance.
3. Orders, Billing & Auto‑Renewal
- Pricing is typically usage‑based (e.g., €2 per GB RAM per 30‑day cycle) and shown at checkout before purchase.
- Payments are processed by third parties (e.g., Stripe). We store references (customer IDs, payment intents) but not full card numbers.
- Unless otherwise stated, services are billed per 30‑day term. If billing is active, we may attempt renewal automatically.
- If a payment attempt fails or no default payment method is present, we will notify you and the renewal may not be completed.
4. Expiration, Suspension & Deletion
- Each service has a defined runtime window (
runtimeUntil). If a term is not renewed by its end, the service may be stopped immediately. - Overdue services may be deleted after a grace period (typically 7 days). Deletion is irreversible.
- We may send reminders (e.g., 7 days, 3 days, and 24 hours before expiry) and payment failure notices; however, timely renewal remains your responsibility.
5. Backups & Data
- Backups, if enabled, are provided on a best‑effort basis and may be subject to retention limits (e.g., daily with limited days of retention).
- Backups are not guaranteed; please keep your own copies of critical data.
- You are responsible for the content you upload or host. Ensure you have necessary rights and that your content complies with these Terms.
6. Acceptable Use
- No illegal activity, harassment, hate speech, malware, phishing, or exploitation of minors.
- No DDoS, stress testing, network abuse, or actions that harm platform stability or other customers.
- Respect intellectual property; remove infringing content upon request or legal notice.
- Resource usage must be reasonable and aligned with your plan; we may throttle or suspend abusive workloads.
7. Support & Availability
- We target high availability (e.g., 99.9% monthly uptime) but do not guarantee uninterrupted service.
- Maintenance windows and third‑party outages may affect availability. We strive to notify you of material events.
- Support channels (e.g., chat, tickets, or community) are provided on a commercially reasonable basis.
8. Intellectual Property
- We retain all rights in the platform, UI, and infrastructure. You receive a limited, revocable license to use the Services.
- You retain ownership of your content. By using the Services, you grant us a license to host and process your content solely to operate the Services.
9. Privacy & Security
- Our Privacy Policy explains how we collect and use personal data.
- We implement technical and organizational measures to protect your data; no system can be 100% secure.
- You must safeguard your credentials and rotate sensitive credentials (e.g., FTP) as needed.
10. Third‑Party Services & Beta
- Third‑party providers (e.g., payment processors) are governed by their own terms and policies.
- Beta or experimental features are provided "as is" without guarantees and may change or be discontinued.
11. Refunds & Credits
- Except where required by law, purchases are non‑refundable once provisioning begins.
- We may, at our discretion, offer service credits for verified platform‑wide incidents; credits have no cash value.
12. Disclaimers & Liability
- The Services are provided "as is" and "as available" without warranties of any kind.
- To the fullest extent permitted by law, we are not liable for indirect, incidental, special, or consequential damages.
- Our aggregate liability for any claim is limited to the fees you paid for the affected service in the 3 months preceding the event.
13. Termination
- You may stop using and delete services at any time via the dashboard.
- We may suspend or terminate access for material breach, abuse, or risk to the platform or others.
- Upon termination, your right to use the Services ends; certain provisions survive (e.g., IP, disclaimers, liability limits).
14. Changes to these Terms
We may update these Terms from time to time. Material changes will be posted on this page and/or communicated via email or in‑app notification. Continued use after changes means you accept the revised Terms.
15. Governing Law
These Terms are governed by the laws of Austria, without regard to conflict of law principles. The courts of Vienna (Austria) shall have exclusive jurisdiction, unless otherwise required by mandatory law.
